US Federal Offenses

US Federal Offenses

Many criminal charges can be prosecuted under federal and state law. Penalties associated with federal offenses are usually much harsher than Florida state offenses. Federal charges are brought against an individual if a federal statute, act, or treaty has been violated, or if the alleged offense involves another state or country.

Considering those federal offenses tend to be more serious than other criminal acts, having legal counsel that can guide you through the intimidating and difficult process while making certain that your rights are being protected is particularly important.

Federal Drug Crimes

One of the many areas of federal crimes that Pumphrey Law handles is federal drug crimes. This involves drug offenses that were either large scale operations or committed in multiple states, allowing for federal action. Some of the main cases that the firm works on include drug trafficking, drug manufacturing and possession of a controlled substance.

Gun charges are also commonly prosecuted federal offenses in Florida. This ranges from lesser infractions like unlawful possession of weapons to more serious gun crimes, such as unlawful import or export of weapons and unlawful firearms trafficking. All of these offenses come with severe potential sentencing.

Another major area of focus for the law office is White Collar Crime. These are generally non-violent offenses and include mail fraud and bank fraud. The firm also takes cases involving money laundering and embezzlement. This representation extends to individuals accused of racketeering (RICO) as well.

The federal offense of Cyber Crime is becoming much more prevalent across the United States and our attorneys are well versed in these relatively new laws. They work with Florida residents accused of offenses such as cyber-extortion, hacking, and other areas of fraud, like identity theft and credit card fraud. They even work with individuals who have been falsely accused of online child pornography, a hot-button issue that is prone to subjective judgments, and this can make it imperative to enlist the aid of an attorney who can aggressively defend you in court.

Violent Crimes are the final area of focus for the legal team with regard to federal crimes. They are ready and willing to represent individuals accused of serious federal crimes, such as kidnapping, rape, and murder. The law firm is here to provide objective and effective legal representation, no matter what the charge, so if you have been accused of these serious crimes, now is the time to work towards a favorable solution.

Penalties

Most federal crimes are defined in Title 18 of the United States Code, and the Federal Sentencing Guidelines are typically followed to uniformly punish federal offenses. Penalties for federal crimes can often include prison time and fines, which are sometimes more severe than what can be expected from a state criminal conviction.

For example, under the federal drug possession and trafficking statutes, the Controlled Substances Act (21 U.S.C. §§ 807 et seq.), punishments can range from less than one year in federal prison to life without parole. Fines can vary from $1,000 to $10,000,000 depending on your charge.

Agencies Who Investigate and Prosecute Federal Offenses

Federal agencies investigate federal offenses before they are prosecuted by the Unites States Attorney’s Office. The most common U.S. investigative agencies are the Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The FBI has jurisdiction over a wide range of federal crimes and investigates almost any crime associated with federal offenses. The DEA primarily investigates felony drug crimes, including drug smuggling into the United States from other countries. The ATF is an investigative agency for violent crimes, criminal organizations, weapon trafficking and terrorism.

United States Attorneys prosecute crimes after they have been investigated by a federal agency. Each United States Attorney is appointed by the President of the United States and is assigned to one of the 94 judicial districts. They collectively serve under the direction of the United States Attorney General.
