Facts
An officer in Wakulla County received a call one evening in reference to a man who was apparently sleeping behind the wheel of his van. When the officer arrived at the scene he notice that a man was indeed sleeping behind the wheel of his white Chevrolet van. The officer began to bang on the window to try to get the man, who ended up being a client of ours, to wake up, and after trying several times our client finally woke up. When the officer was speaking to our client he noticed a strong smell of alcohol on his breathe and instructed him to get out of the vehicle. After our client struggled to get out of the vehicle, the officer assisted him and began a DUI investigation once the man stepped out of his van. The officer then conducted a field sobriety test on our client after smelling the alcohol on him and becoming suspicious. After the officer conducted several tests which our client failed he was then placed under arrest for driving under the influence of alcohol.
