Remain Silent and Don’t Lie!

Remain silent, get the best attorney and no matter what . . . don’t lie!

You have the right to remain silent, why would you lie?  Are you smarter than everyone and convinced you can talk your way out of a situation?  Does someone have a gun pointed to your head threatening to pull the trigger if you don’t lie?  Are you so intimidated by a police officer that you feel it will help your situation?  STOP, THINK, GET THE BEST ATTORNEY! NOW!

Every day in the practice of criminal defense law  (which has been my focus for more than 20 years) I find myself constantly repeating a very specific phrase: “Remain Silent and Do NOT Lie.” I have a number of phrases I ingrain in every person I meet with or talk to in my practice and feel this phrase is a core to any success in defending citizens from the power of government.  It is how I was raised, how I was taught and the only path I personally take.

I feel a great duty and loyalty to any person who crosses my path in life. I do my absolute best to do right by everyone and feel it is one of many contributions to community and country. It is a part of my legacy.

For those who come in contact with the criminal justice system, don’t lie. It isn’t about trying to beat the system or beat a charge or charges, here is a twist: It is the right thing to do and the only way to carry yourself!  If that isn’t enough for you, let me give you a little known secret: it is the very best way to have a successful outcome in any situation involving allegations or arrest.  Success, real empirically proven major league success in court and trial, involves either remaining silent or telling the truth (after having an attorney at your side, don’t every say anything without an attorney present).  Success in any outcome where the government is trying to take your life, liberty or property involves truth and justice. If you are reading this and you are looking for an attorney, or anyone in my office or associated with me in any way, to lie or allow you to lie, stop right here and don’t waste your time nor mine.  Your time would be better spent getting an attorney who will only tell you what you want to here, opening the gates of hell for your future and is a fool.  They are fooling themselves and you about any chance of a successful outcome.  Believe it. 

On the other hand, if you want the very best outcome, doing the right thing to the right people for the right reasons, read on.  If you are about protecting yourself against allegations of wrongdoing, don’t listen to some bush league wannabe who thinks lying or stretching the truth is “strategy”.  Lying is a guaranteed recipe for disaster and a ruse founded on smoke and mirrors, not a strategy for anyone under any circumstance involving any profession.

  The phrase is one that has manifested out of hundreds of trials and the devastating affect it has when someone does not heed the lifelong warning: Don’t ever lie, you have every right NOT to try and outsmart others with deceit and lies.  You have every right to remain silent (although ability to remain silent often escapes those persons questioned by the police, sheriffs, special agents and anyone in the criminal justice system).  The phrase is one that manifested out of seeing innocent citizens having their life destroyed.

Saving the best for last, here is the phrase:

“Lying always takes a bad situation and makes it worse . . . much worse”
